Liability
The perpetrator is liable for the dissemination of the hate speech. Different forms of liability could be applied depending on where and how the hate speech was expressed. Consequences of the activities which publicly incite to hatred, violence or discrimination entail different liability.
Hate speech promotes hatred or violence against individuals or groups based on certain attributes. It is not protected by freedom of expression and can be lawfully prevented and punished.
Right to a fair trial
The right to a fair trial applies to all forms of liability. Both the perpetrator and the victim have rights and duties during the trial. Read more about the right to a fair trial.
