How to request compensation for the decision of a judge?

Right to compensation

You have the right to ask for compensation if you  find that the judge had made an unlawful decision regarding your placement. When considering filing the application for compensation, we advise you to contact The Estonian Patient Advocacy Association since the law and practice on the topic is inconsistent:

Where to complain?

The applications for compensation for damage caused by courts should be submitted to the Ministry of Justice:

By e-mail: info@just.ee

By regular mail to address:
Tõnismägi 5a, 15191 Tallinn

Procedure

When filing the claim, you should explain all the relevant facts, and in your opinion, what rights have been violated and how. The compensation claim can include both material damages (for example, loss of profit because you could not go to work) and moral compensation (for example, the humiliation which you suffered from being detained).

Decision

The ministry is required to make a decision about your claim within two months. In case you do not agree with the decision, you may file an action with an administrative court within thirty days.
