The Chancellor of Justice (in Estonian Õiguskantsler) is an independent official whose duties are to ensure that the legislation valid in Estonia would be constitutional and that the fundamental rights and freedoms of Estonian people are protected. The Chancellor of Justice is independent of the government, parliament and courts.
The Chancellor can investigate complaints related to potential fundamental rights violations and determine whether your rights have been violated. She/he can also suggest the government to amend a law if she/he has discovered that certain legal provisions have a negative effect on fundamental rights or good governance.
The Chancellor can only investigate situations relating to a violation of your fundamental rights by Estonian state institutions. The only exception is discrimination or unequal treatment, where the Chancellor can also investigate the actions of private individuals or companies in Estonia. In all other cases, if a person, who is not a state official, or a private company has violated your rights, you should file a complaint to the institution responsible for investigating such situations (such as the police, the civil court, the Data Protection Inspectorate).
